18 U.S.C. § 2257 Exemption Statement

This notice is to inform you that PickTheChick.com is exempted from 18 U.S.C. § 2257 as it is not a producer of any of the content on the site nor is there any actual images of sexually explicit conduct . Any depiction that is adult in nature is exempt from the provisions of 18 U.S.C. § 2257 and 28 C.F.R. § 75 because: (1) they do not portray conduct specifically listed in 18 U.S.C. § 2256 (2)(A) (i) through (iv); (2) they do not portray conduct as specifically listed in 18 U.S.C. § 2257A created after the effective date of such title; (3) they do not portray depictions of genitals or pubic area created after July 27, 2006; (4) they were created prior to July 3, 1995.

To the extent that there is any “depictions” of acts under those laws it is posted by third parties. The involvement of the operators of this site is limited to the distribution, transmission, hosting, storage, or formatting of any depictions that are posted by third parties, which occur in areas under the third parties control.
