Introduction.

PickTheChick, LLC (“PickTheChick”) respects your privacy.  We are providing this Privacy Policy to let you know how we use, collect, and distribute information that is obtained from you.  This, along with any other Agreement on our Site, governs your use and is a binding contract with us.  Any information we collect and share is encompassed in this document, unless modified by another agreement.  

2.  Your Information

As a condition of using or interacting with PickTheChick, you may be required to provide us with certain information, such as your name, e-mail address, address, demographic information, phone number, financial information, or other relevant information.  This, and other information about you, is defined as “personal information” for the purposes of our Privacy Policy.  We will share personal information with third parties in accordance with this Privacy Policy, or in furtherance of a provision of any other agreement that you may have entered into with us, or may enter into with us in the future, or if we specifically inform you in the future and you agree to share it as a condition of “opting in” to an offer.  

We also collect certain non-identifiable personal information such as your IP address, browser, OS, and more.  If you are from Germany or another country that prohibits the collection of IP addresses or other data, you must notify us IMMEDIATELY so that we may take any and all appropriate action, which may include the termination of any rights you have to access our Site or to scrub any data that you may provide inadvertently.

3.  Creating an Account and Account Security

Certain portions of our site are restricted to those who have registered.  In creating an account, you will be using a login ID, including a username and/or password to interact with our service.   You must not share this login with anyone.  If you believe your account has been compromised you must contact us immediately.  We have the right to terminate any account that we believe is being shared, or violates any provision of this, or other, Agreements.  We also reserve the right to monitor your account usage, as well as to determine when you have provided truthful information in creating your account.  We use industry standard practices in safeguarding your personal information and confidentiality.

4.  Cookies and other non-identifiable personal information

We may use tracking cookies on our website for the purpose of keeping you logged into an account, targeting ads towards you that you may find interesting, or otherwise improving your experience with PickTheChick.   As a result, the enabling of tracking cookies on your computer is mandatory for using PickTheChick.  These cookies, along with any other non-personally identifiable information may be used to allow other members to search the site or to deliver personal messages to you via the Site.  Some of this information may be disclosed to third party advertising partners, to other members on the Site that you have communicated with, or for our own internal purposes.

5.  How we share and email marketing

We share your information with trusted third parties, unless you have previously indicated that you do not wish to receive these messages.  Also, any information that you share on the Site may allow others to contact you.  By engaging in any activity you consent to receive such information.  If you are making a purchase or payment on the Site you are also consenting to us sharing that information with any third party billing providers.  Your information may also be shared to those who we do business with, including any affiliates that may be used to help deliver content or promote our Site, however any such person would be bound by an Agreement that would require that they handle any information with care and not to disclose your information.  

PickTheChic does not like SPAM.  If, at any point, you believe you are receiving emails from us that you should not be receiving you must notify us in writing pursuant to this, or another Agreement.  While you are automatically optd in to receiving some correspondence from us, you may opt out of any advertising or marketing messages that you may receive at any time.   Any emails that you have opted in to receive will be direct information to you that may be informative or useful.  

Additionally, in order to build our e-mail marketing lists, we may collect information from third parties, or compile it ourselves.  If you believe that the collection of your information was unauthorized, please contact us.  If we have the ability we will remove your information and attempt to determine how the collection occurred so as to prevent it in the future.

6.  Third Party Data Storage & Disclosure

We work hard to protect the security of your personal information, and will only share it to the extent that is required to maintain our operations and ensure that our business performs properly.  More specifically, but without limiting the generality of the foregoing, we may store your personal information on third parties’ servers.  We may also allow third parties to access our servers in order to repair, maintain, or improve the servers.

We value our reputation and would not want to have it damaged by allowing others to inappropriately access our users’ data.  Additionally, we have as much to lose from a compromise of our servers’ security as you do.  However, because we do not have control over the actions of third parties, you agree by using our service to not hold us responsible for any damages resulting from this data sharing.

Information that you provide to us during the course of your relationship with our Site is stored on these servers.  In addition, we may store other information on other Sites for marketing purposes.  By deleting your account you understand that we may remove any information we have stored about you, however we may keep some data stored for archive or legal purposes.

7.  Disclosure to Law Enforcement

We may choose to disclose your personal information if we believe it is reasonable to do so in order to protect persons or property, assist law enforcement in a bona fide investigation into allegations of illegal activity, or protect the rights of third parties, such as people whose intellectual property has been infringed on.

8.  Sale or Merger

We may disclose, transfer, or provide your personal information if we, or a parent company, is sold, transferred, or assigned or any part of the business is sold, transferred, or assigned.

9.  California Online Privacy Protection Act

10.  Changes to This Policy

We may change our Privacy Policy from time to time.  Therefore, we encourage you to visit our “Privacy Policy” page frequently to ensure that you are aware of the current version in effect.  We may also e-mail you to notify of changes, though we are not required to do so.  The fact that you were not notified by e-mail of a change in the Privacy Policy will not affect the validity of that change, so you should be sure to check the Privacy Policy each time that you use our service.
